The lawyer for a Texas man accused of killing his wife and children in a shootout outside a Dallas hotel is seeking the death penalty.
Attorney Michael F. Dunlap, who represents the defendant in the death case, was granted a new trial by the Dallas County judge, which is expected to be scheduled for next week.

The judge has granted a motion to reconsider Dunlap’s murder conviction and a new murder trial in the case of John F. Lee Dunlaps wife, daughter and two sons.
Dunlap is also seeking the execution of the defendant.
Dunlap’s defense attorney argued that the defense is “not at a loss” for alternatives to death.
Prosecutors have argued that Dunlap acted with premeditation, that the death sentence would be disproportionate to the crime, and that Dunlap should not be executed.
Defense attorneys are not expected to comment on the case at this time.
A Dallas County jury in April returned a verdict in the murder trial of John Dunlap and his wife, Kathleen, who were shot and killed in their hotel room in June 2016.
Dunlaps death sparked nationwide outrage over the death sentences of more than 100 other defendants for the same crime.
On June 5, Dunlap was found guilty of capital murder, aggravated assault, robbery and aggravated assault with a deadly weapon in the killings of his wife Kathleen Dunlap Dunlap Jr. and his son, Michael Dunlays.
After Dunlap pleaded guilty to murder in January 2018, the judge ruled that the crime could not be capital murder because it was an “accidental, premeditated murder.”
The murder trial was postponed again after a jury in March 2019 found Dunlap not guilty of aggravated assault and robbery.
“I am confident that we will prevail,” Dunlap said in a statement following the jury verdict.
“I look forward to my day in court.”
The death penalty is the punishment for first-degree murder and aggravated murder in Texas.
